TCN Group Pty Ltd ABN 87 626 501 568 (“Card.Gift”) makes a range of non-reloadable digital gift card products, codes and/or vouchers (“Gift Cards”) available for purchase via Card.Gift's website and mobile applications ("the websites"). These Terms and Conditions of Use (“Terms”) apply to all Gift Cards distributed by Card.Gift from the time of your purchase and contains the full set of terms and conditions governing your use of Gift Cards. We recommend that you read these Terms carefully before using a Gift Card. If you do not agree to these Terms, do not make any purchases from the Websites. Card.Gift reserves the right to change or modify these Terms at any time at Card.Gift's sole discretion. Card.Gift will provide notice of any change or modification by sending you a notification, or by updating these Terms. We do not charge any fees for using the Card. However, to the extent permitted by law, some merchants may charge you for using the Card and such fees may be deducted from the balance of your Card at the time of the transaction. A 2.99% foreign exchange conversion fee applies to transactions in any currency other than Australian dollars and is calculated on the Australian dollar transaction amount. This will be included in the total transaction amount debited to the Card.
Any refunds on Card transactions are subject to the policy of the specific merchant. If the Card expires or is revoked before you have spent any funds resulting from a refund then you will have no access to those funds. You cannot “stop payment” on any transaction after it has been completed. If you have a problem with a purchase made with the Card, or a dispute with a merchant, you must deal directly with the merchant involved. If you cannot resolve the dispute with the merchant, you can contact TCN Customer Support.
Please choose carefully as we do not offer exchange or refund on Gift Cards. A re-issue of faulty or damaged Gift Cards is not available unless the fault or damage to the Gift Card is proven to be a result of the production or issuing process or otherwise due to the fault of us or our agents or contractors or where otherwise required by law. If you seek a return or refund please contact support@card.gift.com with the reason for your request and proof of purchase for us to review. If any value on a Gift Card has been spent, we are unable to process a return or refund unless required to by law. Card.Gift is not responsible for the refund of purchase price or return of any products purchased from Retailers.
Treat your Gift Card like cash. Lost or stolen Gift Cards will not be replaced or refunded. The bearer of the Gift Card will be taken to be the owner of the Gift Card. If you lose your mobile device, please contact us immediately so we can put a hold on your account. If someone has partially or fully redeemed your Gift Card(s) while your mobile device is lost or stolen, Card.Gift shall not be liable.
Card.Gift attempts to be as accurate as possible however sometimes errors may occur. We do not represent or warrant that any description, Gift Card, Retailer or pricing information displayed on our Service is accurate, complete, reliable, current or error-free. In the event of an error, we will endeavour to correct it as quickly as possible and revise your order accordingly, or to cancel the order and refund any charged amount.
These Terms are to be construed and enforced in accordance with the laws of Victoria, Australia. Any dispute in connection with a Gift Card is exclusively subject to the jurisdiction of the courts of Victoria, Australia (including the Federal Court of Australia, Victoria Registry).
We do not charge any fees for using the Card. However, some merchants may charge you for using the Card and such fees may be deducted from the balance of your Card at the time of the transaction. A Currency Conversion Fee is payable by you when you make a transaction on your Card in a currency other than Australian dollars. A Currency Conversion Fee may also be payable if you make a transaction on your Card in any currency (including AUD) that is processed by a card scheme or financial institution or billed by the merchant outside of Australia. It may not always be clear, particularly when purchasing online, that the merchant, financial institution or card scheme processing is located outside of Australia.
Any refunds on Card transactions are subject to the policy of the specific merchant. Refunds may be in the form of a credit to the Card, cash refund or in-store credit. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds. Refunds in currencies other than Australian dollars are converted to Australian dollars as at the date they are processed by using exchange rates determined by them. This may lead to the refund being converted using an exchange rate different from the one used to convert the original purchase. The converted Australian dollar amount appears on your transaction history as the transaction amount.
You are responsible for all transactions on the Card, except where there has been fraud or negligence by our staff or agents. We may restrict or stop the use of the Card if suspicious activities are noticed You are responsible for checking your transaction history, knowing the available balance and date of expiry for the Card. Balance and transaction history are available to you within the app on your Device. Apple and Apple Pay are trademarks of Apple Inc., registered in the U.S and other countries. We reserve the right to change these Terms and Conditions at any time. Any changes to the Terms and Conditions can be viewed at www.thecardnetwork.com.au.
